Welcome to Aetherist (“Aetherist,” “we,” “us,” or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of the Aetherist website, applications, APIs, and services (collectively, the “Services”). By accessing or using the Services, you agree to be legally bound by these Terms.

If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use Aetherist. By using the Services, you represent and warrant that:

  • You have the legal capacity to enter into these Terms.
  • You will comply with all applicable laws and regulations.
  • If using Aetherist on behalf of a company, you are authorized to bind that entity.

2. Description of Services

Aetherist provides AI-powered tools, automation systems, and digital assistant functionality that may include:

  • AI-generated content
  • Data analysis
  • Communication automation
  • Task management
  • Workflow execution
  • API integrations
  • Third-party service interactions

We reserve the right to modify or discontinue features at any time.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of your credentials
  • Notify us immediately of unauthorized access
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use Policy

You agree NOT to use Aetherist to:

  • Violate any laws or regulations
  • Engage in fraud, deception, or impersonation
  • Infringe intellectual property rights
  • Generate illegal, harmful, or abusive content
  • Attempt unauthorized access to systems
  • Distribute malware or malicious code
  • Circumvent security safeguards

We may suspend or permanently ban users who violate this policy.

5. AI-Generated Content Disclaimer

Aetherist uses artificial intelligence models that generate outputs based on patterns and probabilities. You acknowledge:

  • AI outputs may be inaccurate or incomplete.
  • You are responsible for reviewing and verifying outputs before use.
  • Aetherist is not liable for decisions made based on AI-generated content.
  • AI responses do not constitute legal, financial, medical, or professional advice.

6. Intellectual Property

All rights, title, and interest in the Services, including Software, Models, Algorithms, Design, Branding, and Documentation are owned by Aetherist or its licensors.

Users retain ownership of content they submit but grant Aetherist a limited license to use it solely to provide and improve the Services.

7. Data & Integrations

If you connect third-party services (e.g., email, payment providers, cloud storage), you authorize Aetherist to access and process data strictly as required to perform requested actions.

We are not responsible for third-party platform policies or outages.

8. Payments & Subscriptions

If applicable: Fees are billed in advance. Subscriptions renew automatically unless canceled. Refunds are provided only as required by law or explicitly stated. Failure to pay may result in service suspension.

9. Termination

We may suspend or terminate access if: You violate these Terms, required by law, or your use poses risk to the platform. Upon termination, your access rights cease immediately.

10. Limitation of Liability

To the maximum extent permitted by law, Aetherist shall not be liable for: Indirect or consequential damages, loss of profits, data loss, business interruption, or errors in AI-generated content. Our total liability shall not exceed the amount paid by you in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold Aetherist harmless from claims arising out of: Your misuse of the Services, your violation of law, or content you submit or generate.

12. Governing Law

These Terms shall be governed by the laws of the Republic of India. Any disputes shall be resolved in the courts of that jurisdiction.

13. Changes to Terms

We may update these Terms periodically. Continued use of the Services after changes constitutes acceptance.

15. Autonomous AI Actions, Misuse & User Responsibility

15.1 User Responsibility for AI Agents

Aetherist may allow users to configure, deploy, or operate autonomous or semi-autonomous AI agents capable of performing actions, executing workflows, interacting with third-party systems, sending communications, processing transactions, or otherwise acting on behalf of the user (“User AI Agents”).

You acknowledge and agree that: Any action performed by a User AI Agent is deemed to be an action performed by you. You are solely responsible for configuring, supervising, monitoring, and controlling your User AI Agents.

15.2 Prohibited Autonomous Use

You may not configure or deploy a User AI Agent to engage in illegal activities, conduct fraud, harass others, circumvent security, or perform actions intended to cause harm.

15.3 Immediate Termination Rights

Aetherist reserves the absolute and immediate right to suspend or terminate access if a User AI Agent is determined to be malicious, unlawful, or harmful.

15.4 No Liability for User AI Conduct

Aetherist shall not be liable for damages or legal actions arising from actions performed by User AI Agents. The user bears full responsibility for compliance with laws and ethical standards.

16. Third-Party Services & Infrastructure

16.1 Google Authentication

By choosing to authenticate via Google, you authorize Aetherist to receive certain profile information. Your use of Google services is governed by Google’s own Terms of Service.

16.2 Cloud Infrastructure & Data Hosting

Aetherist utilizes Google Cloud Platform (GCP) to host and process user data. Google acts as a data processor under contractual obligations to maintain security.
